FAITH FLOWERS LLC DBA EXPLORE FLOWER TOURS
FLOWER TOUR AGREEMENT
Italy: Tuscany, Marche & More, including the Pre-Tour Option
Pre-Tour: April 24 – 26, 2027
Main Tour: April 27 – May 8, 2027
Tour Cost: Total Tour Cost includes both travel coordination by Faith Flowers, LLC dba Explore Flower Tours and all scheduled activities described on the itinerary, including tour guides, transportation to and from activities, class instructors, entry fees (gardens, sites, museums, etc), and bus driver gratuity. Double occupancy or single occupancy hotel rooms for 11 nights, breakfast every day, 8 lunches, and 8 dinners are included in the Main Tour. Double occupancy or single occupancy hotel rooms for 3 nights, breakfast every day, 2 lunches, and 1 dinner are included in the Pre-Tour.
Tour Cost Subject to Change: Tour Cost is an estimate based on a 19-person trip Main Tour and 15-person Pre-Tour and group lodging (hotel fees are subject to change until confirmed). Tour Cost may be increased if the Tour does not reach at least 19 travelers on the Main Tour and 15 travelers on the Pre-Tour. Further, Tour Cost may be adjusted based on changes to the Itinerary.
Excluded Costs: Airfare, travel from airport to hotel, passports fees, entry/exit visa costs, COVID-19 and health fees, personal gratuities, laundry and dry cleaning, personal transportation outside of group transportation, wines, liquors, beverages, personal excursions, and meals (other than those listed on the Itinerary) are not covered by the Tour Cost.
Tours are limited in space and are available on a first come basis.
Main Tour Non-Refundable Deposit: You agree to make a $3,000 deposit paid to secure your registration (the "Deposit"). The Deposit is non-refundable under all circumstances.
Main Tour Payment Schedule: Payment #1 (Deposit of $3,000) is due upon registration. Payment #2 (50% of remaining Tour Cost) is due October 1, 2026. Payment #3 (final 50% of remaining Tour Cost) is due February 1, 2027. Failure to make payments by the due dates may result in automatic cancellation of your registration and forfeiture of all payments made to date, at the sole discretion of Faith Flowers, LLC dba Explore Flower Tours. A late payment fee of $150 will be assessed for any payment received more than 10 days after the due date. If Faith Flowers, LLC dba Explore Flower Tours allows you to continue on the Tour despite late payment, you agree to pay all outstanding amounts plus late fees no later than 30 days prior to departure, and Faith Flowers, LLC dba Explore Flower Tours may require payment by credit card, wire transfer, or certified check. ALL deposits and payments for the Tour are non-refundable.

Payment Methods: For the initial deposit, payment is preferred by credit/debit card. We are not responsible for payments that do not reach us by mail in a timely manner resulting in not securing a spot on the Tour. For payments #2 and #3, you will be invoiced by Faith Flowers, LLC and payment by ACH (bank payment) or check is preferred. Payment by credit/debit card will incur an administrative fee of 3.75%. Cancellation: Faith Flowers, LLC dba Explore Flower Tours undertakes substantial efforts at travel coordination for the Tour, including research, communication with vendors, securing appropriate entry to activities, and negotiating accommodations. Many costs (fees for activities or hotel) are paid by Faith Flowers LLC dba Explore Flower Tours in advance of travel and are not subject to refund, would affect the Tour Cost if refunded, or would require extensive efforts to secure refund in the event of your cancellation. Therefore, ALL deposits and payments for the Tour are non-refundable.
Itinerary Changes and Substitutions: Faith Flowers, LLC dba Explore Flower Tours reserves the right to make changes, substitutions, or modifications to the Tour itinerary at any time, including before or during the Tour, due to circumstances including but not limited to: weather conditions, availability of venues or guides, safety concerns, operational issues, or other unforeseen circumstances. Faith Flowers, LLC dba Explore Flower Tours will make reasonable efforts to provide comparable substitutions when changes are necessary. You acknowledge that such changes may occur and agree that Faith Flowers, LLC dba Explore Flower Tours shall not be liable for any disappointment, inconvenience, or additional expenses resulting from itinerary changes. No refunds will be provided for itinerary changes unless the change constitutes a substantial alteration to the Tour as determined solely by Faith Flowers, LLC dba Explore Flower Tours, in which case a partial refund may be provided at Faith Flowers, LLC dba Explore Flower Tours's discretion.
Air Transportation: You agree to arrange airline travel separately and are solely responsible for any and all fees related to air travel. You are solely responsible for any and all penalties and fees incurred as a result of program cancellation (whether by you or by Faith Flowers, LLC dba Explore Flower Tours and/or change in travel dates or airline schedules or delays.
Travel Insurance: Faith Flowers, LLC dba Explore Flower Tours recommends, in the strongest possible terms, insurance that includes coverage for trip delay/interruption/cancellation, baggage loss/delay, loss or theft of personal property, and medical expenses (including medical evacuation). You are responsible for securing your own travel insurance.
Health: The Tour often requires walking multiple miles per day, stair climbing and standing for up to one hour or more on uneven surfaces. By signing this agreement, you are certifying that you have no physical, mental, or medical condition or disability that would create a hazard for you or other Tour travelers, or that would require special accommodation or assistance not reasonably available during the Tour. You agree to disclose any medical conditions, dietary restrictions or physical limitations that may affect your participation in the Tour at least 90 days prior to departure. Failure to disclose such conditions may result in your removal from the Tour without refund if Faith Flowers, LLC dba Explore Flower Tours determines that your participation poses a risk to yourself or others.
Personal Property and Valuables: You are solely responsible for your personal property and valuables throughout the Tour. Faith Flowers, LLC dba Explore Flower Tours and its representatives are not responsible for any loss, theft, or damage to your personal belongings, including but not limited to luggage, cameras, electronics, jewelry, cash, or other valuables. You are strongly encouraged to secure appropriate travel insurance that covers loss or theft of personal property. Faith Flowers, LLC dba Explore Flower Tours recommends that you keep valuables with you at all times and utilize hotel safes when available. You agree to hold Faith Flowers, LLC dba Explore Flower Tours harmless from any claims related to loss, theft, or damage to personal property during the Tour.
International Travel: You are fully responsible for complying with any passport, visa, and immigration requirements and associated fees that apply to the Tour, including any requirements regarding Covid-19 vaccination or status, or any other required vaccinations and associated expenses. It is recommended that you review any governmental alerts, advisories, warnings, and prohibitions that apply to the Tour destinations. Faith Flowers, LLC will not be responsible for any loss or damage, including inability to travel, due to your failure to comply with such requirements.
Code of Conduct and Removal from Tour: You agree to conduct yourself in a respectful and appropriate manner throughout the Tour. Faith Flowers, LLC dba Explore Flower Tours reserves the right to remove you from the Tour, without refund, if your behavior is disruptive, dangerous, disrespectful to other Tour travelers, Tour guides, instructors, vendors, or local residents, or violates local laws or customs. Behaviors that may result in removal include, but are not limited to: intoxication, harassment, failure to follow instructions from Tour guides or Faith Flowers, LLC dba Explore Flower Tours representatives, or any conduct that jeopardizes the safety or enjoyment of other Tour travelers. If you are removed from the Tour, you will be responsible for all costs associated with your early departure and return travel. Faith Flowers, LLC dba Explore Flower Tours will not be liable for any expenses incurred as a result of your removal from the Tour.
Photography and Media Release: Faith Flowers, LLC dba Explore Flower Tours reserves the right to take photographs and/or video recordings during the Tour for promotional, educational, or marketing purposes. By signing this agreement, you grant Faith Flowers, LLC dba Explore Flower Tours permission to use your name, likeness, image, voice, and/or appearance in photographs, videos, or other media related to the Tour. These materials may be used in print publications, online publications, presentations, websites, and social media. You waive any right to royalties or other compensation arising from or related to the use of such materials. If you do not wish to be photographed or recorded, you must notify Faith Flowers, LLC dba Explore Flower Tours in writing at least 30 days prior to departure.
Indemnity: You hereby agree to indemnify, defend, and hold harmless Faith Flowers, LLC dba Explore Flower Tours, its member-owners, managers, and employees, agents, contractors, instructors or affiliated tour guides for all claims, harms, losses, delays, expenses (including reasonable attorney’s fees) or damages of any kind arising from the Tour, including those involving personal injury or death (including related to Covid-19 or other infectious diseases), caused by (a) the negligent or international behavior of you or any person traveling with you as part of your party; (b) your failure to follow instructions from Faith Flowers, LLC dba Explore Flower Tours representatives or tour guides; (c) your violation of local laws or customs; or (d) the acts or omissions of third party providers of Tour lodging, transportation, accommodations, activities or services. This indemnity obligation shall survive the termination of this agreement.
Limitation of Liability: Faith Flowers, LLC dba Explore Flower Tours acts only as the coordinator of the Tour and shall not be responsible in any way for damages, losses, delays, or refunds arising from the performance or non-performance provided by third-party providers of Tour lodging, accommodations, or activities.
Force Majeure: Neither party shall be responsible for any failure to perform any obligation due to unforeseen circumstances or causes beyond that party’s reasonable control, including acts of God, pandemic situation, war, riot, acts of civil/military authorities, fire, floods, or labor strikes. Unless mutually agreed to by the parties, the term “pandemic situation” shall mean if the Federal, State, or Local government having jurisdiction over the locations of the Tour, due to Covid-19 (or variant) or any other infectious disease, issues any law, executive order, or similar proclamation (the “Regulation”) within 90 days of the Tour (regardless of the expiration date of the Regulation) that prohibits travel to the Tour destination by a majority of Tour Travelers. Pandemic Situation shall not include situations (and no force majeure event shall be triggered) in which the Regulation requires social distancing or personal protective equipment, proof of vaccination or negative testing, or prevents some scheduled activities. You accept the risk that modifications may be made to the Tour due to Regulations that are unknown at the time of signing. Your decision to cancel due to Regulations that do not create a Pandemic Situation shall be treated as a cancellation and be subject to the Cancellation Fees and forfeitures set forth above. Should a force majeure event occur, Faith Flowers, LLC dba Explore Flower Tours shall make good faith efforts to provide refunds of the Tour Cost to the greatest extent possible (depending on whether refunds or returns are allowed by hotels, common carriers, vendors, etc. However, you assume risk of loss of any or all of the Tour Cost from cancellation due to a force majeure event. Further, you acknowledge that even if a force majeure event occurs, Faith Flowers, LLC dba Explore Flower Tours shall be entitled to retain the Cancellation Fee based on work performed.
Assumption of Risk and Waiver of Claims: You acknowledge that participation in the Tour involves inherent risks, including but not limited to: risks associated with international travel, transportation by various means, exposure to different climates and environments, consumption of unfamiliar foods, visits to gardens and outdoor venues with uneven terrain, participation in walking tours and physical activities, and potential exposure to illness or disease (including Covid-19 and its variants). You voluntarily assume all risks associated with participation in the Tour, whether or not described above, including risk of personal injury, death, property damage, or loss. You expressly waive any and all claims against Faith Flowers, LLC, its member-owners, managers, employees, agents, and representatives for any injury, illness, death, loss, or damage that may occur during or as a result of the Tour, except for claims arising from the gross negligence or willful misconduct of Faith Flowers, LLC. This waiver applies to claims based on negligence, breach of contract, breach of warranty, or any other legal theory.
